These terms and conditions (the “Terms and Conditions”) govern the use of myfyrst.com (the “Site”) and all associated programs, workshops, in-person sessions, events, presentations, digital tools, and any other activities or services offered by My Fyrst (collectively, the “Services”). This Site is owned and operated by My Fyrst.

By using this Site, attending a workshop, participating in any My Fyrst event or program, or engaging with any of the Services in any form, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Nature of the Program

My Fyrst is a self-guided, self-help emotional awareness practice. All activities, programs, workshops, journal exercises, text message prompts, webinars, in-person sessions, and any other content or services provided by My Fyrst are designed for general personal wellness and self-reflection purposes only.

My Fyrst is not therapy, counselling, or any form of clinical or professional mental health service. It is not a substitute for professional psychological, medical, or psychiatric support. Participation in any My Fyrst activity or program is entirely voluntary, and you engage at your own initiative and discretion.

My Fyrst does not:

  • diagnose, treat, cure, or prevent any mental health condition, psychological disorder, or medical condition;
  • provide or claim to provide any medical, psychological, psychiatric, or clinical advice;
  • claim to heal or resolve any mental health problem or issue; or
  • act as a replacement for any qualified health, wellness, or mental health professional.

If you are experiencing a mental health concern or crisis, please seek support from a qualified mental health professional.

Disclaimer

My Fyrst activities, content, tools, workshops, and all associated Services are intended solely for general wellness, self-reflection, and personal growth purposes. My Fyrst makes no representations or warranties, express or implied, regarding the accuracy, completeness, suitability, or effectiveness of any content, activity, or program for any individual. You acknowledge and agree that:

  • results from participation in any My Fyrst activity or program will vary by individual;
  • no specific outcomes, improvements, or results are guaranteed;
  • all information and content provided is for general informational and self-reflection purposes only; and
  • reliance on any information or content provided through the Services is solely at your own risk.

Please exercise caution and ensure your personal safety at all times while engaging in the My Fyrst practice, including during physical, reflective, or journaling activities.

My Fyrst is not equipped to provide crisis support. If you or someone you know is in crisis, experiencing a mental health emergency, or in immediate danger, please seek help immediately:

Participation and Age Requirements

My Fyrst activities, programs, workshops, and Services are intended for participants aged 13 and above. The following conditions apply:

  • participants under the age of 13 are not permitted to participate in any My Fyrst activity, workshop, event, or program;
  • participants aged 13 to 17 may participate when accompanied by a parent or responsible adult who agrees to these Terms and Conditions on their behalf; and
  • adults accompanying minors are responsible for determining the appropriateness of any activity for the minor in their care.

My Fyrst reserves the right to decline participation to any individual where it determines, in its sole discretion, that participation may not be appropriate or safe.

Intellectual Property

All content published and made available through the Site and Services is the property of My Fyrst and its creators. This includes, but is not limited to, images, text, logos, documents, journal frameworks, activity designs, the My Fyrst Method, downloadable files, and any other content that contributes to the composition of the Site or Services. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content without the prior written consent of My Fyrst.

Acceptable Use

As a user of the Site and participant in any My Fyrst Service, you agree to use the Site legally and in good faith, and not to:

  • harass or mistreat other participants, users, or team members;
  • violate the rights of other users of the Site;
  • violate the intellectual property rights of My Fyrst or any third party;
  • hack into or otherwise gain unauthorised access to accounts on the Site;
  • act in any way that could be considered fraudulent; or
  • post any material that may be deemed inappropriate or offensive.

If we believe you are using the Site or Services illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend, or terminate your access to the Site. We also reserve the right to take any legal steps necessary to prevent you from accessing the Site or Services.

Sale of Services

These Terms and Conditions govern the sale of services available on the Site. The following services are available:

  • Wellness and Wellbeing programs;
  • Holistic Life Coaching;
  • Workshops and in-person sessions; and
  • Digital tools and resources.

The services will be paid for in full when the services are ordered. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from the Site at your own risk.

We reserve the right to modify, reject, or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Privacy and Personal Data

My Fyrst is committed to protecting the privacy of all users, subscribers, and participants. The collection, use, and storage of personal data is governed by our Privacy Policy, which forms part of these Terms and Conditions and is available at myfyrst.com/privacy-policy.

In the course of providing the Services, My Fyrst may collect the following personal data:

  • first and last name;
  • email address;
  • phone number;
  • mailing address (for journal delivery); and
  • payment information.

This data may be collected through the following means:

  • subscribing to the My Fyrst program or services;
  • signing up for the My Fyrst newsletter or community;
  • completing any form on the Site; and
  • signing up at a My Fyrst workshop, event, or in-person session.
  • by texting the My Fyrst keyword to activate SMS delivery of daily activity prompts.

Personal data is collected and used solely to deliver the Services to you. My Fyrst does not sell personal data to any third party. Data is retained for the duration of your subscription and for one (1) year following the end of your subscription, after which it is securely deleted. Daily activity prompts are delivered via SMS text message. For details on consent and how to opt out, please refer to our Privacy Policy. For any data-related complaints, please refer to the complaints process set out in our Privacy Policy at myfyrst.com/privacy-policy.

SMS Communications

My Fyrst delivers daily activity prompts via SMS to subscribers who have explicitly opted in. Your mobile number is collected at checkout but no messages are sent until you activate your subscription by texting the My Fyrst keyword, found inside your Active Minds Journal or shared at in-person My Fyrst workshops in Calgary.

Texting the keyword constitutes your explicit opt-in to receive approximately 6 SMS messages per week from My Fyrst. Messages may consist of multiple SMS segments due to length.

Upon texting the keyword you will receive a one-time confirmation SMS. Your daily prompts begin the following morning.

My Fyrst is the sender of these messages. Standard message and data rates may apply depending on your mobile carrier and plan.

You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation that your opt-out has been processed, after which no further prompts will be sent. To reactivate, text the keyword again at any time.

Your mobile number is shared with our SMS service provider solely for the purpose of delivering your daily activity prompts. This provider processes your data on our behalf and is contractually prohibited from using it for any other purpose.

Email Communications

My Fyrst may send email communications to subscribers and community members who have provided their email address. These may include daily activity prompts, subscription confirmations, program updates, community news, webinar invitations, and information about My Fyrst services.

In accordance with Canada’s Anti-Spam Legislation (CASL), all marketing emails will clearly identify My Fyrst as the sender and include an unsubscribe link. Unsubscribe requests will be honoured within 10 business days.

Transactional emails related to your active subscription — including billing, shipping, and account notices — may still be sent following an unsubscribe request as they are necessary to deliver the service.

Third Party Goods and Services

The Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on the Site.

Subscriptions

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription. To cancel your subscription, please do so at any time before the next billing cycle. Please ensure you cancel your subscription at least 48 hours before the next billing cycle.

Payments

We accept Credit Card payments on the Site. Additional payment methods may be available from time to time as indicated at checkout.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Payments on this Site are processed by a third-party payment processor. By completing a purchase, you agree that your payment information will be shared with this processor solely for the purpose of completing your transaction. My Fyrst does not store or have access to your full payment card details. The processor’s terms and privacy policy are available via our Billing page.

Refunds

We provide refunds for services sold on the Site as follows:

  • there is no refund offered for the subscription service. You may cancel your subscription before your next renewal or billing cycle;
  • we do not offer refunds or returns once the journal has been shipped; and
  • refund eligibility for workshops and in-person events will be communicated at the time of booking.

Additional Terms

The following additional terms apply to all users of the Site and participants in any My Fyrst Service:

  • My Fyrst does not claim to heal or solve any mental health problems or issues. My Fyrst does not provide or claim to provide any medical advice including psychological advice;
  • My Fyrst is not responsible for any personal or property damage or injury incurred, including any mental health impact, while practising the suggested daily activities. It is presumed that the person practising these activities will do so in a responsible and safe manner;
  • My Fyrst activities require adult supervision for all minors as set out in the Participation and Age Requirements section above;
  • My Fyrst activities may suggest requirements for additional resources that may incur costs beyond the subscription fee. My Fyrst will not be responsible for reimbursement of these additional costs; and
  • photography and/or filming may take place at My Fyrst workshops, events, and in-person sessions. Participants’ privacy will be maintained throughout. If you have any concerns, please speak with a My Fyrst team member before the session begins.

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

My Fyrst and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site, participation in any workshop, event, or program, or engagement with any My Fyrst Service.

Indemnity

Except where prohibited by law, by using this Site or participating in any My Fyrst Service, you indemnify and hold harmless My Fyrst and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of the Site or Services or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Alberta, Canada. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Alberta.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate the Site and Services. Changes will be posted on the Site. We recommend that users periodically review these Terms and Conditions to ensure they are aware of any updates.
